License Agreement

MAMP GmbH ("we") grants you a limited, non-exclusive, non-transferable license to install and use serrv on macOS computers you own or control, subject to these terms.

serrv may be used free of charge to run a limited number of local websites. Free use is permitted for personal and commercial purposes.

serrv max — a paid subscription with no limit on the number of websites. Each license key covers one Mac. With team plans, each user receives their own license key; each key is an independent license.

You may not:

• copy, distribute, sell, sublicense, or transfer serrv or your license key to any third party;
• reverse-engineer, decompile, or disassemble serrv, except to the extent expressly permitted by applicable law;
• remove or obscure any copyright, trademark, or other proprietary notices;
• circumvent or disable any license-protection mechanisms in serrv;
• use serrv in any manner that violates applicable law.

serrv max is sold as a monthly subscription. Billing, payment processing, invoicing, and tax collection are handled by Polar as Merchant of Record. By purchasing, you also agree to Polar's Terms of Service.

You may cancel your subscription at any time via the customer portal. Access to serrv max continues until the end of the current billing period. No partial refunds are issued for unused subscription time, unless required by applicable law or Polar's refund policies.

We reserve the right to change the subscription price for new purchases. Existing subscriptions permanently keep the price at which they were taken out — price changes apply only to new purchases.

We may release updates to serrv at our discretion. Updates are provided under the same terms. We are not obligated to provide particular updates or to maintain particular features.

serrv and all associated content, trademarks, and intellectual property rights are and remain the exclusive property of MAMP GmbH. This agreement does not grant you any ownership rights in serrv. All rights not expressly granted to you by this agreement remain with MAMP GmbH.

serrv includes third-party open source components, which remain under their respective licenses. See Open Source Licenses for details.

This license is effective until terminated. It terminates automatically if you breach these terms.

We may terminate this agreement for cause with reasonable notice — in particular for a serious or repeated breach of these terms or upon discontinuation of the product. If we terminate without fault on your part, we will refund the pro-rated unused portion of your subscription.

Upon termination you must stop using serrv and delete all copies in your possession. Sections 2, 5, 7, 8, and 11 survive termination.

serrv is provided "as is" without any express or implied warranty, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that serrv will be error-free or uninterrupted, or that it will meet your specific requirements.

To the extent applicable law does not permit the exclusion of implied warranties, the above exclusions apply to the fullest extent permitted by law.

To the fullest extent permitted by applicable law, MAMP GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of serrv, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or related to serrv shall not exceed the amount you paid us for serrv in the twelve months preceding the claim.

The above limitations do not apply to damages arising from injury to life, body, or health, or from gross negligence or wilful misconduct by MAMP GmbH.

This agreement is governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions. The exclusive place of jurisdiction for all disputes arising out of or in connection with this agreement is Munich, to the extent permitted by law.

If you are a consumer resident in the European Union, the mandatory consumer protection provisions of the country in which you reside also apply.

We reserve the right to update this agreement from time to time. We will notify you of material changes at least 30 days before they take effect — by email or via an in-app notice. Continued use of serrv after a change takes effect constitutes your acceptance of the revised terms. If you do not agree, you may cancel your subscription before the change takes effect.

This agreement constitutes the entire agreement between you and MAMP GmbH regarding serrv and supersedes all prior understandings, agreements, or representations relating to its subject matter.

If any provision of this agreement is found to be wholly or partially invalid or unenforceable, that shall not affect the validity of the remaining provisions. The invalid provision shall be deemed replaced by a valid one that comes closest to the economic purpose of the original provision.
